Capitalized terms have specific meanings defined below. They apply whether they show up singular or plural. For purposes of these Terms and Conditions: • Affiliate means an entity that controls, is controlled by or shares common control with a party. • Country refers to: Washington, United States • Company (referred to as "the Company", "We", "Us" or "Our") refers to FieldDriver. • Device means any device that can access the Service such as a computer, smartphone or tablet. • Service refers to the FieldDriver platform. • Terms and Conditions (also "Terms") form the entire agreement between You and FieldDriver regarding Service use. • Third-party Social Media Service means services or content provided by third parties displayed or included by FieldDriver. • Website refers to FieldDriver. • You means the individual accessing the Service, or the organization on whose behalf they access it.

Acknowledgment

These Terms and Conditions govern use of FieldDriver and form the agreement between You and the Company. They set out rights and obligations for all users. Your access to and use of FieldDriver is conditioned on accepting and complying with these Terms. They apply to all visitors and users. By accessing FieldDriver You agree to be bound by these Terms. If You disagree with any part, You may not use the Service. You represent that You are over 18. FieldDriver does not permit users under 18.

Links to Other Websites

FieldDriver may contain links to third-party websites or services not owned or controlled by the Company. The Company has no control over and assumes no responsibility for third-party content, privacy policies or practices. You acknowledge that FieldDriver is not responsible for any damage or loss caused by or related to third-party content, goods or services available through external websites.

Termination

We may terminate or suspend Your access immediately, without notice or liability, for any reason including breach of these Terms. Once that happens, Your right to use FieldDriver stops.

Limitation of Liability

The Company's liability under these Terms shall be limited to the amount You paid through FieldDriver or around a hundred dollars if You haven't purchased anything. To the maximum extent permitted by law, the Company and its suppliers shall not be liable for special, incidental, indirect or consequential damages (including loss of profits, data loss, business interruption, personal injury, privacy loss or inability to use FieldDriver), even if advised of such damages or if the remedy fails its essential purpose.

"AS IS" and "AS AVAILABLE" Disclaimer

FieldDriver is provided "AS IS" and "AS AVAILABLE" with all faults and defects without warranty. To the maximum extent permitted by law, the Company expressly disclaims all warranties, whether express, implied, statutory or otherwise, including merchantability, fitness for particular purpose, title and non-infringement. The Company makes no representation or warranty: (i) regarding operation, availability or content of FieldDriver; (ii) that it will be uninterrupted or error-free; (iii) as to accuracy, reliability or currency of information; or (iv) that FieldDriver or its servers are free of viruses, scripts, malware or harmful components.

Governing Law & Disputes Resolution

The laws of the Country, excluding conflicts of law rules, shall govern these Terms and Your use of FieldDriver. Your use may also be subject to other local, state, national or international laws. If You have concerns or disputes about FieldDriver, try to resolve them informally by contacting the Company first.

Compliance & Regulations

For European Union (EU) Users: If You are an EU consumer, You benefit from mandatory provisions of Your country's law. United States Legal Compliance: You represent and warrant that (i) You are not in a country subject to US embargo or designated as terrorist-supporting, and (ii) You are not on any US prohibited or restricted parties list.

Severability and Waiver

If any provision of these Terms is unenforceable or invalid, it will be modified to accomplish its objectives under applicable law. The rest stays in effect. Failure to exercise a right or require performance shall not affect future exercise of such right. Waiving one breach doesn't mean You waive the next one.

Changes to These Terms and Conditions

These Terms may have been translated. The original English text prevails in disputes. The Company reserves the right to modify or replace these Terms at any time. We'll give You at least a month's notice before material revisions take effect. If You keep using FieldDriver after the changes, You accept them.
